Health Guarantee 2018

Health Guarantee for Schnauzers Of Taylor
1) 48 hour guarantee: This puppy is in good health to the best of my knowledge by my own observation and using a seasoned veterinarian’s for exam. Buyer has 48 hours to have their new puppy examined by a licensed veterinarian, excluding Saturday & Sunday. Puppies picked up on Friday, must see vet on Monday. Failure to have the puppy checked within these 48 hours voids all guarantees. All vaccines must be administered by a licensed veterinarian ONLY. The breeder holds the right to have the puppy re-examined by their veterinarian to validate. Ear cropping and any vet expenses incurred by the buyer will not be refunded. Seller guarantees against fatal viruses for 48 hours after purchase. These include, but are not limited to, PARVO, DISTEMPER, CORONA. No guarantee on fatal viruses after 48 hours. We also cannot guarantee that your puppy will never develop any health problems, just like a pediatrician cannot guarantee that a child will never develop any health problems in the future. . Breeder does not guarantee against common puppy issues such as but not limited to coccidia, which can be caused by stress, worms, giardia, ear mites or kennel cough. These are common puppy ailments and can easily be treated. Your puppy has been treated on a schedule from the age of 2 weeks for these conditions and it is now the Buyers responsibility to continue on any needed treatments and have the puppy checked for parasites on a regular basis.
2) First Two Years: Puppy is guaranteed against any congenital disease that results in an unfortunate death of the puppy within the first 24 months** (see extension to 36 months***) of life. If the puppy dies then the buyer will pay for an necropsy to ascertain reason for death. If the reason is congenital (congenital defects are abnormalities which are untreatable and mean certain death), the breeder will replace the puppy at no additional cost to the buyer.
Extended Warranty:
***Animal health is Breeder’s top priority.
We feel that Lifes Abundance is a superior system for your puppy, we highly recommend it.
For feeding your puppy Lifes Abundance food and supplement system for the first 24 months of its life will extend the congenital disease replacement to 3 years.
However, under no circumstances will the health guarantee last longer than thirty-six (36) months or will the health guarantee continue if Buyer otherwise fails to comply with the terms of this Agreement.

** Years 2-5: After year one we commit to you that if your puppy has any issues, where as the puppy cannot live a healthy life we will issue you the following credit towards a new puppy: 35% of the original puppy price excluding shipping cost and vet fees.  **Breeder will not replace or refund for any personal reasons, but not limited to, allergies, mortality, landlord’s disapproval, family disagreement or any other problems not related to health, nor for a puppy’s death caused by neglect, exposure to weather, injury, choking, poisoning, etc. Breeder does not guarantee for any type hernias, patella luxation, cancer or retained testicles. Breeder does not guarantee environmental allergies, food allergies, schnauzer bumps, shot knots or vaccine reactions, teeth not falling out, over or under bites, minor heart murmurs level 1 or 2, hypoglycemia or thyroid issues. Small dogs do have trouble with bites when baby teeth that do not fall out are not removed, failing to do so cause the other teeth to grow in crooked. Breeder is not responsible for reactions by vaccines or rabies shots and it is not included as part of your health guarantee. No guarantee is also given on hypoglycemia (low blood sugar) which is preventable. All AKC papers and medical records must be returned. Note: The breeder cannot guarantee size or temperament. The breeder can only estimate the size based of weight and the size of the parents. Puppies could grow larger or stay smaller than projected size, the same as children. Breeder cannot guarantee ears will stay floppy, anything can happen in schnauzer ears. Breeder does not guarantee color, coat quality, or reproductive capability or lifespan of puppy. This puppy is PET quality only.
3) Death of puppy within guarantee: If for any reason the puppy dies within the period of the health guarantee due to a supposed congenital defect, an autopsy examination by an accredited institution set up to do such exams, such as a university such as Texas A&M, must accompany the request for a puppy replacement within the first year. Autopsies done by a local veterinarian is not accepted. The owner of the pup will pay the expenses. Ear cropping, and any vet expenses incurred by the buyer will not be included. Puppy will be replaced from a future litter within 3 yrs, no money will be refunded.
5) Abuse &Neglect: This guarantee is null and void upon any evidence of abuse or neglect. This includes failure to complete vaccinations, worming and puppy checks with a qualified veterinarian. Proof of said maintenance must be furnished upon request of breeder. You have purchased this a pet and family member and it is expected that Buyer will treat with love and kindness.
6) Vaccines: Vaccines must be no less than three weeks apart and no more than four weeks apart for a series of three. Rabies vaccines cannot be administered before 16 weeks of age. Breeder is not responsible for reactions by vaccines or rabies shots and it is not included as part of your health guarantee. Internal flea preventatives should not be used and will void your guarantee. Monthly heartworm preventative is required or it will void your guarantee. Buyer agrees to keep records and record of quality food. Failure to abide by these terms will void the Health Guarantee.
7) Reproduction: Any dog that has sired or whelped one or more pups is no longer covered under this guarantee.
8) Registration: This puppy is sold with either a AKC registration as PETquality or with a birth certificate or pedigree depending on your choice.
9) Changing Possession: If for any time the Buyer can no longer retain possession of the dog, the Breeder is to be contacted and given the first option to resume full ownership. The dog will be returned with their veterinarian records and all paperwork issued for the dog, including any AKC registration documents. Breeder is always willing to take dog back at no cost to breeder at anytime in their life. Breeder does not want any of their dogs in any shelter or rescue. Breeder must approve new home. Breeder must be contacted when Buyer moves with new contact information.
10) Signature: This agreement has been entered into by the Breeder (Schnauzers Of Taylor) and the Buyer in the state of Texas and the laws of the State of Texas shall determine all the questions pertaining to the construction and validity of this agreement. The parties involved agree that this contract has been executed in Williamson, Texas. Any action brought under this contract may be brought in only within the Judicial Circuit in Williamson Texas. If buyer shall default on their obligations under this agreement, which default results in expenditure of attorney fees and/or court cost, to enforce the terms of this agreement or to recover damages for breach of this agreement, or to defend against a lawsuit brought by the Buyer and the Breeder prevails, then the Breeder shall receive payment for all reasonable necessary cost in anticipation, and preparation for litigation; including, but not limited to, attorney fees, and all travel expenses incurred by them and their attorney. All guarantees and replacements are subject to the breeder still breeding schnauzers. Breeders are subject to life and situations that can impact ability to continue to do some of things they love, like breeding. If for some unforseen reason the breeder no longer breeds schnauzers no replacement or credit will be due the buyer. It is mutually understood and agreed that all terms and agreements in this contract shall be extended to and be obligatory upon to any heirs, executors, administrators, successors, and Personal Representatives of the respective parties and/or their assigns. I, AS THE BUYER, OR HIS/HER REPRESENTATIVE, OF THIS PUPPY, HAVE READ, UNDERSTAND, AND AGREE TO THE ABOVE GUARANTEE. Acceptance of puppy or puppies is acceptance of this agreement.

*~*~*~*~*Our Home/Visits**~*~*~~*

We are very much a schnauzer family. We are dedicated to providing only the best start in life for your baby.

Our babies are raised in our home.  I wouldn't have it any other way. They are under my constant supervision including a baby monitor so I can hear them at night and a TV monitor so I can see them while in other parts of the house. For the first 2weeks our puppies are spoken to, loved and cuddled several times per day. We also start our early neuro stimulation on day 3 and continue to day 16. During this time our eyes open. Starting at 3-5 weeks of age we get moved into our larger play area so we have lots of room to move around. We also get introduced to the litterbox.We have "puppy playtime" daily. During this time they are allowed to explore inside and after our first set of shots, outside.

Our grown dogs have their own play area in our back which they enjoy when out. They have a very large basket of toys to play with that is rotated to prevent boredom. They are crated only at night for sleep. No cages and pens here! When cold weather strikes they have access to their area in our garage for shelter or home.

I had somebody that wants to be placed on my wait list for next year ask me this "If I were to come to your house unexpected right now, what would I smell"....I appreciate all my questions that I get. For the many parents that have had the opportunity to visit my house know that you probably would smell bleach or my Circle E candles burning. I am picky about cleaning down the puppy room 3 times a week with bleach water, bedding daily (more if needed) and papers and litter once or twice daily. Dishes and bowls are ran through the dishwasher after each use. Blankets are washed daily. Because my pups are in my house living with us, it is imperative that nothing smells.
We do not offer tours of our dog areas. This is our home and would not be appropriate for me to come "check out yours" before I sold a puppy to you. You have to realize that our dogs are not used to being around small children and although their pups make wonder family pets that doesn't mean that mine will enjoy being around yours.

We welcome visits after pups are 6 weeks and you have completed a questionnaire and we have checked references etc. This is for our protection, for our pups protection and for health reasons. Thank you for understanding.

It should be noted that this Contract defines the responsibilities of both parties to the Contract, that it is made and signed to assure the well-being of the animals involved and their progeny, and that it constitutes full agreement of the parties with regard to breeding of the Schnauzer bitch and Schnauzer stud listed below.

BITCH OWNER(S) agree(s) to provide:

__legible photocopy of the AKC registration certificate of the bitch,
__proof of DNA certification through AKC,
__legible photocopy of her pedigree, and
__proof of current shots and wormings.

BITCH OWNER(S) also agree(s) to have the bitch bathed, groomed, and free of fleas or parasites before delivering bitch for breeding.

STUD OWNER(S) reserve(s) the right to refuse stud service if the bitch:
__Is not AKC registered,
__Is not DNA certified through AKC,
__Is deaf,
__Is not sound in temperament and/or conformation, or
__Appears unhealthy, obese, or in poor condition.

STUD OWNER(S) agree(s) to house the visiting bitch in a safe and comfortable environment with all necessary precautions unless otherwise agreed upon; however, STUD OWNER(S) will not be held responsible for her injury or loss.

STUD OWNER(S) guarantee(s) to practice due diligence in providing the necessary environment for an actual mating (and “tie”) ONLY, and do(es) not guarantee pregnancy nor puppies, living or dead, will ensue from this mating. BITCH OWNER(S) hereby release(s) from responsibility STUD OWNER(S),descendents and heirs from any and all liabilities and/or damages to said bitch while she is in the care of STUD OWNER(S).

If the bitch fails to be in whelp (pregnant), BITCH OWNER(S) must give notice not later than sixty-five (65) days after the date of mating. STUD OWNER(S) agree(s) to provide a repeat stud service for no additional stud fee to the same bitch in her next season, or another bitch with approval of the STUD OWNER(S), under the same terms of this Contract in the event that two or more puppies do not result from this breeding.

STUD OWNER(S) reserve(s) the right to charge a boarding fee at the rate of $7.00 per day, after the seventh (7th) day.

BITCH OWNER(S) hereby agree(s) that this Schnauzer bitch will not be bred to any other male dog during her heat cycle, other than the stud listed herein, and that utmost care will be taken to ensure that she is not bred to any other male after stud service has been provided.

BITCH OWNER(S) agree(s) to pay any and all incurred expenses, including stud, bitch, veterinarian,
delivery, boarding, and any other miscellaneous expenses, if required, associated with or
incurred for the purpose of breeding this Schnauzer bitch, and acknowledge that STUD OWNER(S) is/are not liable or responsible for any expenses incurred in association with the breeding of this Schnauzer bitch.

BITCH OWNER(S) certify(ies) that (th)he(y) will not sell offspring from this breeding to any agent, pet store, puppy mill, kennel, or individual or agent of an individual whose purpose is mass production, wholesaling or retailing of Schnauzers, i.e., any mass-producing kennel or business. BITCH OWNER(S) will immediately pay a penalty of $500.00 to STUD OWNER(S) for each puppy offered in breach of this condition. Puppy also shall be sold with only limited AKC registration unless prior arrangements for approved home are made. The bitch owner (breeder) agrees to be responsible for the offspring of this litter and to take puppies back if necessary.

Payment of the stud fee shall be:
$ ___$750_____ U.S. Dollars, payment due upon breeding and the
STUD OWNER(S) agrees to sign(s) the litter AKC limited registration papers.

There will be no refund of stud fee in part or in full.
A live litter shall be construed as two (2) live schnauzer puppies, and they are alive at seven (7) days of age or will constitute a breeding at the bitche’s next heat/season to the above-named stud. STUD OWNER(S) are not responsible for medical conditions of the bitch resulting in deaths of the puppies after day 7.

This Contract will remain valid and may be enforced by STUD OWNER(S) until such time as this Contract is fulfilled. This Contract does not extend beyond the $750 payment for stud services and the guarantee of 2 live births until day 7.

Should it become necessary to enforce any part of this Contract by legal means, appropriate attorney’s fees, court costs, and all travel expenses will be the responsibility of THE OWNER(S) of this schnauzer bitch. This Contract will be deemed a legally binding
Contract, and is under the jurisdiction of the state of Texas, in the county of Williamson. It is further agreed that the place of venue shall be Williamson County, Taylor Texas
